Etsy OEM & Production Partners: Who Is the Manufacturer?
You designed a canvas bag, sent the drawings to a workshop and ordered 100 units. The finished bags carry your brand. Then Etsy asks for the manufacturer’s details. Do you enter your business or the workshop?
In this arrangement, your business will generally be the GPSR manufacturer. Having someone else make the bags does not remove that role. What matters includes who arranged production and whose name or trademark the product is marketed under. (EU GPSR)
Etsy Production Partners and GPSR Manufacturers: What Is the Difference?
Etsy uses “production partner” to describe outside help producing qualifying items, including your original designs. GPSR uses “manufacturer” to identify a business or individual with product safety responsibilities. Those roles can sit with different businesses: your workshop may be your Etsy production partner while you are the manufacturer under GPSR.
There is another distinction worth checking. Etsy’s current guidance excludes white-label manufacturers, OEMs and ODMs from its production-partner category, while separately recognising contract manufacturers producing to your specifications. Check the actual arrangement against Etsy’s rules before adding a supplier. (Etsy production partner guidance)
Being the manufacturer under GPSR does not, by itself, make an item eligible for Etsy. Etsy’s Creativity Standards still apply, including its conditions for original designs and production assistance. (Etsy Creativity Standards)
Who Is the Manufacturer in Common Etsy Selling Setups?
These examples apply the manufacturer rules to typical arrangements. They assume the products fall within GPSR scope; Etsy eligibility must be checked separately. (EU product compliance guidance)
The European Commission’s GPSR guidance gives a similar rebranding example: a business buys mugs from another company, adds its own logo and sells them to consumers. The business selling the branded mugs becomes the manufacturer. (European Commission guidance)
If a factory both makes and markets an unchanged product under its own identity, it may be the manufacturer to identify. If it manufactures for a separate brand owner, that brand owner may be the relevant manufacturer instead.
How to Check Your Own Manufacturer Role Under GPSR
Start with one finished product, rather than your shop as a whole. Did you commission its design or manufacture? Is it presented as your product, under your business name or brand? Or are you clearly selling another manufacturer’s branded item? Having an Etsy shop name does not, by itself, turn every product you resell into your own-brand product. Check the product branding, labels, packaging, listing claims and supply agreement together.
A supplier calling itself “the manufacturer” on an invoice does not settle your legal role. Outsourcing production does not let an own-brand manufacturer pass its responsibilities to the factory. (EU Blue Guide) Also check whether you have changed the product. A substantial modification affecting safety can trigger manufacturer obligations even without rebranding. (EU GPSR)
Whose Manufacturer Details Should You Add to Your Etsy Listing?
Enter the manufacturer identified from your actual selling arrangement. If that is your business, provide its manufacturer identity and contact details. Connect your brand clearly to the business or individual behind it. If you are reselling another manufacturer’s unchanged product, use that manufacturer’s information. Etsy currently provides manufacturer and product safety fields in its listing forms. Its guidance calls for the manufacturer’s name, postal address and electronic address, plus the EU Responsible Person’s details where the manufacturer is outside the EU. Check that the information displayed applies to that particular product. (Etsy GPSR guidance)
A descriptive production-partner title such as “Apparel printer” does not replace the required manufacturer information. Etsy allowing that title in a partner profile does not change the product safety disclosure requirements. (Etsy production partner guidance) Check the physical item too. Manufacturer details must appear on the product or, where that is not possible, its packaging or an accompanying document. An Etsy listing alone does not replace this requirement. (EU GPSR)
How Your Manufacturer Role Affects EU Responsible Person Documents
Confirm the manufacturer before arranging representation. Where an EU Responsible Person acts as an authorised representative, the written mandate comes from the manufacturer. If your business is the own-brand manufacturer, the appointment should identify your business and the covered products. (EU market surveillance rules)
For genuine resale, first check the original manufacturer’s EU arrangements and product coverage. Your shop’s service order is not automatically a mandate from that manufacturer. Equally, a factory’s existing RP arrangement should not be assumed to cover products marketed under your separate brand. Appointing an RP does not transfer your manufacturer responsibilities.
Your product records should connect the manufacturer, brand, product identifiers and actual production source. The technical documentation needs to describe the product you sell and support its safety assessment. A supplier’s test report may form part of that evidence; it is not the complete technical file. (European Commission guidance)
In practice, a report issued in the factory’s name may still be useful. Check whether the tested model, materials, construction and relevant variants match your finished product, and which risks the tests actually address. For example, if the report identifies factory model F12 but your listing uses SKU BAG-01, ask for supporting specifications, photographs and a written explanation linking the two. A similar-looking sample is insufficient evidence of a match. Changes to coatings, components or decoration also need checking. A different name on the report does not automatically require new testing. Equally, adding your logo does not automatically extend a report’s coverage. The connection needs evidence. These are practical checks for deciding whether supplier evidence supports your finished product. (EU guidance on assessing product compliance)
Before You Update Your Etsy GPSR Information
Take one product through this sequence: confirm how it is branded and supplied, identify the manufacturer, check the supporting documents, then align the Etsy information, physical labelling and any RP mandate. Repeat that check where your sourcing model changes. One shop can contain products with different manufacturers.
If you are unsure how your production arrangement fits, Optimalcert’s EU Responsible Person and GPSR support can help you review the roles, available documentation and information needed before EU sales.
